FOIL DRIVE Product Liability Statement

WARNING: Before assembling, setting up or using this product, it is imperative to thoroughly read and adhere to all instructions and warnings provided in the User Guide. The information in this statement affects your safety and legal rights and responsibilities. 

WARNING: Failure to operate our products in a safe and responsible manner may result in serious injury or death to yourself or others, and/or damage to property (including to our products). 

Acknowledgment: You understand and acknowledge that our products are associated with a high level of risk. You operate our products at your own risk. To the maximum extent permitted by law, you expressly and voluntarily assume the risk of personal injury or death sustained while using our products. You acknowledge that you have read, understood and agreed to comply with this Product Liability Warning and Liability Release.

Learning to Foil Drive: You must review official Foil Drive content to learn proper technique and riding safety information. You must use the propeller guard during learning phases. You must release the throttle immediately on falling off the Foil Drive. You must avoid riding near or offshore from swimmers and surfers to prevent accidents. 

Usage Caution: This product is not a toy. This product must be operated with caution and common sense and requires basic mechanical ability. Caution must be exercised when operating the produce in the presence of others. This product is not intended for use by person (including children) with reduced physical, sensory or mental capabilities, or lack of experience or knowledge, unless they have been given supervision or instruction concerning use of the appliance by a person responsible for their safety. Children should be supervised to ensure they do not play with the appliance.  

Environmental Considerations: Consider the safety of your surroundings before operating a Foil Drive. Do not ride in shallow water (less than 1.5m in depth), rocky areas, or during severe weather conditions. Some states or countries may require a license or permit for using a Foil Drive. 

Modification: Do not use third-party accessories or modify this product outside the guidelines provided by Foil Drive. Any use of third-party accessories or non-permitted modifications with the product will void any warranties and Foil Drive will not be liable for any damage to the product or injury to persons.  

Intended Use: Foil Drive systems are designed for operation by a single individual over the age of 16 (or as per local laws) for the purpose of hydrofoiling. It is not intended for transporting passengers or towing objects or people. Foil Drive systems are to be retrofit installed and operated on hydro foiling surfboards as described in the product manual and Foil Drive’s published online instructional content only. Installation must strictly follow instructions for safe and intended use. 

Foil Driving Safety: The Foil Drive system comprises a lithium battery, water-resistant enclosure, and motor system with a spinning propeller. These components include sharp edges, pinch points, and electrical and chemical elements. 

  • Falling Hazard: Falling on the Foil Drive or any connected component can cause serious injury or death. 

  • Safety Gear Recommendation: Always wear approved safety gear, including an impact vest/PFD and helmet, as per local regulations. Refer to manufacturer’s safety, care, and maintenance guidelines for your gear. 

Propulsion System: The Foil Drive propulsion system includes a powerful spinning propeller. 

  • Keep Away Warning: Keep body, fingers, and toes away from the spinning propeller at all times. Contact with the propeller can cause serious injury or death. 

  • Handling Precautions: Never touch the propeller whether in or out of the water, especially when the Foil Drive battery is connected. Operate at a safe distance from other watercraft, swimmers, surfers, divers, and wildlife. Avoid seaweed or contaminated water. 

Foil Drive Lithium Ion Batteries: The Foil Drive system includes a Lithium Ion Battery.  

WARNING! Battery can be highly flammable. 

DO NOT expose to high temperature, humidity, direct sunlight, flame, water. 

DO NOT drop, puncture, dismantle, modify or re-purpose battery or charge 

DO NOT use if wet or damaged - overheating, swelling, leaking, corroding. 

DO NOT short circuit or connect terminals in reverse. 

DO NOT over charge/discharge battery 

ONLY USE Foil Drive supplied equipment as directed in manuals.  

ALWAYS inspect all electrical components before charging or use. 

ALWAYS apply Foil Drive Battery Grease before use. 

ALWAYS disconnect battery from Foil Drive/charger immediately after use. 

ALWAYS monitor when charging in non-flammable environment. 

ALWAYS charge inside the lipo safe storage bag. 

ALWAYS store between 30-50% charge. 

ALWAYS dispose of in compliance of local regulation
